1. Overview
These Terms of Service ("Terms") govern your access to and use of Tastebuds AI (the "Service"), operated by Marco Singhof ("we", "us"). By creating an account or using the Service, you agree to be bound by these Terms.
2. Eligibility and accounts
You may use the Service only if you are able to form a binding contract with us and are at least 16 years old. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
3. Subscription, billing, and cancellations
We offer paid subscriptions for certain features. Payments are processed by Stripe, Inc. and its affiliates ("Stripe"), a third-party payment processor. By starting a subscription, you authorize us and Stripe to charge the applicable fees to your chosen payment method on a recurring basis until you cancel.
You can manage or cancel your subscription from the billing settings in the app. Unless required by law, fees are non-refundable except where we explicitly state otherwise in the app or in a separate policy.
Your use of Stripe's payment processing services is subject to the Stripe terms and conditions and Stripe Global Privacy Policy (together, the "Stripe Agreements"), as updated by Stripe from time to time. By using the payment features of the Service, you agree to be bound by the Stripe Agreements and authorize Stripe to store and continue billing your specified payment method, including after expiry, to avoid interruptions in payment. We are not responsible for payments processed by Stripe or for Stripe's handling of your data.
We may change the prices for the Service from time to time. If we change prices, we will provide notice of the change on the Service or by email, and the change will take effect at the next renewal of your subscription term. The new price will automatically apply as of the renewal date unless you choose not to renew. Your renewal and continued use of the Service after the price change becomes effective constitutes your agreement to pay the changed amount.
4. Acceptable use
You agree not to use the Service to:
- Violate any applicable law or regulation
- Infringe or misappropriate the rights of others, including intellectual property or privacy rights
- Upload or share content that is unlawful, harmful, abusive, hateful, or otherwise objectionable
- Attempt to probe, scan, or test the vulnerability of the Service, or disrupt or overload our infrastructure
- Abuse AI features (for example, generating harmful content, or attempting to bypass usage limits or security controls)
General practices regarding use and storage. You acknowledge that we may establish general practices and limits concerning use of the Service, including without limitation the maximum period of time that data or other content will be retained, and the maximum storage space that will be allotted on our servers on your behalf. We are not responsible or liable for the deletion of, or failure to store, any data or other content maintained or uploaded through the Service. We may terminate accounts that are inactive for an extended period of time and may change these general practices and limits at any time, with or without notice.
5. Your content
You retain ownership of the recipes, notes, and other content you create or upload to the Service. You grant us a limited, non-exclusive, worldwide license to host, store, process, display, and use that content only as needed to operate and improve the Service and to provide features you request (such as sharing recipes or using AI to generate or refine them).
You are responsible for ensuring you have the necessary rights to upload and use any content in this way and that your content does not violate these Terms.
Feedback. If you send us any questions, comments, suggestions, ideas, or other feedback about the Service ("Submissions"), you agree that such Submissions are non-confidential and become our property. We are free to use and share Submissions for any purpose, commercial or otherwise, without acknowledgment or compensation to you.
6. AI-generated content
The Service uses third-party AI models (such as OpenAI) to generate or transform content. AI outputs may be inaccurate or incomplete and should be reviewed carefully before you rely on them. In particular, you are responsible for checking that AI suggestions are suitable for your dietary needs, allergies, and any other constraints.
7. Intellectual property
The Service, including its design, features, and underlying software, is owned by us or our licensors and is protected by intellectual property laws. These Terms do not grant you any ownership in the Service. You may not copy, modify, or create derivative works based on the Service except as expressly allowed by these Terms.
Open source and third-party materials. From time to time, we may use or distribute third-party software (including open source software), documentation, or other materials in or with the Service. Such materials are subject to their own license terms, which may grant you additional rights or impose additional restrictions. To the fullest extent permitted by law, we are not liable for any third-party content or materials (including open source software), including for any errors or omissions or any loss or damage incurred as a result of your use of them. We do not pre-screen user content, but we and our designees reserve the right (but not the obligation) to refuse or remove any content that violates these Terms or is otherwise objectionable in our sole discretion. You are solely responsible for evaluating and bearing all risks associated with the use of any content.
8. Disclaimers
The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee that the Service will be uninterrupted, error-free, or secure, or that any content (including AI-generated content) will be accurate or complete.
9. Limitation of liability
To the fullest extent permitted by law, in no event will we be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of or inability to use the Service.
Our total liability for any claim arising out of or relating to the Service or these Terms is limited to the amount you paid for the Service in the twelve (12) months preceding the event giving rise to the claim, or $50 if you have not paid anything.
10. Termination
You may stop using the Service at any time and can cancel your subscription through the billing settings. We may suspend or terminate your access to the Service if you materially breach these Terms, abuse the Service, or if we are required to do so by law. Upon termination, your right to use the Service will end, but sections that by their nature should survive (such as limitations of liability) will continue to apply.
11. Changes to the Service and Terms
We reserve the right to modify or discontinue, temporarily or permanently, the Service (or any part of it) in our sole discretion, including to reflect changes in applicable laws and regulations, make technical adjustments and improvements (for example, to address a security threat), or update or improve the Service.
We may also update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. If a change is material, we may notify you by email or by a notice in the app. Your continued use of the Service after any changes to the Service or these Terms become effective constitutes your acceptance of the changes.
12. Governing law
These Terms are governed by the laws of the United States and the laws of the state in which you reside in the United States, without regard to conflict of law principles. You and we agree to submit to the personal jurisdiction of courts located in the United States in connection with any dispute arising out of or relating to these Terms or the Service.
